1. INTRODUCTION
These Terms of Use (“Terms”) govern access to and use of the ecommerce marketplace platform operated by Amas Don International, operating under the abbreviated name Amas Don (“Amas Don,” “we,” “us,” or “our”), including www.amasdon.com and all related services, features, applications, and functionalities (collectively, the “Platform”).
By accessing or using the Platform, you agree to be legally bound by these Terms. If you do not agree, you must immediately discontinue use of the Platform.
These Terms constitute a legally binding agreement between you and Amas Don.
2. MARKETPLACE ROLE & PLATFORM STATUS
2.1 Amas Don operates as an online marketplace facilitating transactions between independent third-party sellers (“Sellers”) and buyers (“Buyers”).
2.2 Amas Don is not the seller, manufacturer, importer, exporter, distributor, agent, or owner of products listed by Sellers unless explicitly stated.
2.3 The contract of sale is concluded directly between Buyer and Seller. Amas Don is not a party to that contract.
2.4 Amas Don does not guarantee:
product quality, safety, or legality
Seller performance
accuracy of listings
availability of products
2.5 Amas Don acts as an intermediary information society service provider under applicable EU legislation, including the Digital Services Act.
3. ELIGIBILITY
3.1 Users must be at least 18 years old or the legal age of majority in their jurisdiction.
3.2 Business Sellers must be legally registered entities.
3.3 Amas Don reserves the right to conduct identity verification (KYC) and request documentation at any time.
4. ACCOUNT REGISTRATION & SECURITY
4.1 Users must provide accurate and up-to-date information.
4.2 Users are responsible for safeguarding login credentials.
4.3 Users are liable for all activity under their accounts.
4.4 Amas Don may suspend accounts suspected of fraud, abuse, or unauthorized access.
5. SELLER OBLIGATIONS
Sellers agree to:
Provide accurate, lawful, and complete listings
Ensure compliance with product safety laws
Fulfill orders promptly
Provide valid business information (including VAT where applicable)
Comply with consumer protection laws
Pay applicable taxes
Sellers are solely responsible for product legality, warranties, tax compliance, and regulatory obligations.
6. BUYER OBLIGATIONS
Buyers agree to:
Provide accurate shipping/payment information
Pay all applicable charges
Review listings carefully before purchase
Submit lawful and genuine reviews
7. PROHIBITED PRODUCTS & ACTIVITIES
The following are strictly prohibited:
Illegal drugs and controlled substances
Weapons and ammunition
Counterfeit goods
Stolen property
Pirated digital content
Hazardous or restricted materials
Products violating sanctions or export laws
Manipulated or fake reviews
Malware, phishing, or fraud schemes
Amas Don may remove listings or suspend accounts without prior notice.
8. PAYMENTS & PLATFORM FEES
8.1 Payments are processed through third-party providers.
8.2 Platform fees may include commissions, listing fees, subscriptions, or processing fees.
8.3 Fees are non-refundable unless explicitly stated.
8.4 Amas Don may modify fees with prior notice.
8.5 Payouts may be delayed or withheld in cases of fraud, chargebacks, or compliance review.
9. CHARGEBACKS & FRAUD PROTECTION
9.1 Sellers bear financial responsibility for chargebacks related to their sales.
9.2 Amas Don may impose administrative handling fees.
9.3 Suspicious transactions may be blocked pending verification.
10. DELIVERY & RISK TRANSFER
10.1 Sellers are responsible for shipping and logistics.
10.2 Risk transfers according to applicable consumer law.
10.3 Amas Don is not liable for shipping delays or carrier errors.
11. WITHDRAWAL & REFUNDS
11.1 EU consumers have a 14-day right of withdrawal unless statutory exceptions apply.
11.2 Sellers must comply with consumer protection law.
11.3 Disputes regarding returns are primarily between Buyer and Seller.
12. RATINGS & REVIEWS
12.1 Reviews must reflect genuine purchasing experiences.
12.2 Fake or incentivized reviews are prohibited.
12.3 Amas Don may moderate or remove reviews violating policy.
13. DIGITAL SERVICES ACT (DSA) COMPLIANCE
13.1 Users may report illegal content via support@amasdon.com.
13.2 Notices are acknowledged within 2 business days.
13.3 Decisions are issued within 14 days.
13.4 Internal complaint mechanisms are available.
13.5 Ranking transparency: Product visibility may depend on relevance, pricing, seller performance, customer ratings, delivery reliability, and promotional status.
Users may request additional information regarding ranking parameters.
14. ARTIFICIAL INTELLIGENCE TRANSPARENCY
AI systems may be used for:
Search ranking
Fraud detection
Personalized recommendations
Dynamic pricing
AI-generated outputs do not guarantee suitability or availability.
15. DATA PROTECTION (GDPR)
Personal data is processed in accordance with GDPR.
Data is retained only as necessary for contractual, legal, and regulatory purposes.
Users may exercise rights of access, rectification, erasure, restriction, and portability.
Full Privacy Policy is available on the Platform.
16. TAX RESPONSIBILITY
Sellers are solely responsible for VAT calculation, reporting, and payment.
Amas Don does not provide tax advice.
17. SANCTIONS, RESTRICTED COUNTRIES & EXPORT COMPLIANCE
17.1 The Platform may not be used in violation of sanctions or export control laws imposed by the EU, UN, Republic of Croatia, OFAC, or other competent authorities.
17.2 Users represent that they are not located in or resident of sanctioned jurisdictions nor listed on sanctions lists.
17.3 At the time of this update, transactions may be restricted or prohibited in, including but not limited to:
Comprehensive Sanctions Jurisdictions:
North Korea (DPRK), Iran, Syria, Cuba, Russia, Belarus, Sudan (where applicable)
Occupied or Sanctioned Regions:
Crimea, Donetsk (occupied areas), Luhansk (occupied areas), Kherson (occupied territories), Zaporizhzhia (occupied territories)
High-Risk or Logistically Restricted Countries:
Afghanistan, Somalia, Yemen, Libya, Eritrea
Conflict or Restricted Zones:
Certain territories affected by armed conflict or embargo, including parts of Palestine such as the Gaza Strip.
17.4 This list is non-exhaustive and may change without notice.
17.5 Amas Don reserves the right to:
Block access from specific jurisdictions
Cancel transactions
Withhold payouts
Suspend accounts
Restrict shipments
17.6 Amas Don shall not be liable for losses resulting from sanctions compliance actions.
18. INTELLECTUAL PROPERTY
All trademarks, branding, software, and content are owned by Amas Don or respective rights holders.
Unauthorized use is prohibited.
19. PLATFORM AVAILABILITY
The Platform may experience downtime, maintenance, or technical interruptions.
Uninterrupted access is not guaranteed.
20. TERMINATION & SUSPENSION
Amas Don may suspend or terminate accounts for violations, fraud, or legal risk.
Funds may be withheld during investigation.
21. LIMITATION OF LIABILITY
To the maximum extent permitted by law, Amas Don shall not be liable for indirect, incidental, special, or consequential damages.
Total liability shall not exceed the fees paid to Amas Don in the preceding 12 months.
22. INDEMNIFICATION
Users agree to indemnify and hold harmless Amas Don from claims arising from:
Platform use
Legal violations
Third-party rights infringement
23. FORCE MAJEURE
Amas Don is not liable for delays caused by events beyond reasonable control.
24. DISPUTE RESOLUTION
Disputes shall be resolved by binding arbitration in Osijek, Republic of Croatia, unless mandatory consumer law provides otherwise.
Language: English or Croatian.
Awards are final and binding.
Class action participation is waived where legally permissible.
25. GOVERNING LAW
These Terms shall be governed by the laws of the Republic of Croatia, without regard to conflict of law principles.
26. ENTIRE AGREEMENT / SEVERABILITY / WAIVER
These Terms constitute the entire agreement between Users and Amas Don.
Invalid provisions do not affect the remainder.
Failure to enforce a right does not constitute waiver.
27. COMMUNICATION
Users consent to electronic communication.
